1. Who We Are
This Privacy Policy is issued by Portcast Pte Limited (company number 201729069G), located at Level 6, Vanguard Building, 1 Kallang Junction, Singapore 339263 (“Portcast,” “we,” “us,” or “our”).
Portcast provides a Software-as-a-Service (SaaS) platform that uses machine-learning-based software and real-time external data sources, together with Portcast's proprietary algorithms, to predict international cargo flows (the “Service”). This Privacy Policy explains how we handle information in connection with the Service.
2. Scope of This Policy
This Policy applies to the information Portcast processes in the course of providing the Service to our business customers (each, a “Client”) and their authorized users (“Permitted Users”). Portcast's Service is provided on a business-to-business basis under a SaaS agreement with each Client, and much of the information described below is governed by the terms agreed with that Client.
3. Key Terms
For clarity, this Policy uses the following terms as defined in our customer agreements:
Personal Data
Has the meaning given in Singapore's Personal Data Protection Act 2012, and includes, for example, a user's name and email address.
Data
All data, content, and information (including Personal Data) that is owned, held, used, or created by or on behalf of a Client and that is stored using, or input into, the Service.
Derived Information
Anonymized, aggregated, and de-identified statistical and analytical data that Portcast generates from Data and from information about a Client's use of the Service, processed so that it cannot identify the Client or any individual user.
4. Information We Collect
In connection with the Service, Portcast collects and processes:
- Permitted User information: the name and email address of individuals a Client authorizes to access the Service, along with any other information the Client provides about those users so they can be registered and trained on the Service.
- Client Data: the data, content, and information a Client stores in, or inputs into, the Service in the course of using it. This may include Personal Data relating to the Client's own contacts or data subjects, which the Client controls and is responsible for.
5. How We Use Information
Portcast uses the information described above to:
- Provide the Service, including permitted user registration, user training, upgrades, and bug fixes;
- Exercise our rights and perform our obligations under our agreement with the relevant Client, including accessing Data where necessary to operate the Service;
- Generate Derived Information from Data and usage information. Derived Information is processed so that it cannot identify the Client or any individual, and Portcast may use and disclose it, in anonymized, aggregated, and de-identified form only, for our business purposes worldwide — including market research, performance analysis, and improving the Service.
Portcast does not review, monitor, or verify the accuracy or legality of Client Data, except where required by applicable law.
6. Our Role as a Data Intermediary
Where Data contains Personal Data, Portcast processes that information solely as a data intermediary under Singapore's Personal Data Protection Act 2012 (or the equivalent concept under other applicable privacy laws), acting on behalf of the relevant Client.
The Client remains solely responsible for obtaining all necessary consents, permissions, and approvals from data subjects for the collection, use, and processing of their Personal Data, and for its own compliance with applicable data protection laws. Portcast is not responsible for ensuring a Client's compliance with data protection laws.
7. International Storage and Transfer of Data
Portcast may store, process, or transfer Data in secure servers located in Singapore or in other jurisdictions where Portcast or its service providers operate, and may access such Data from time to time as necessary to provide the Service. Portcast complies with the applicable data protection laws governing the storage and transfer of Data in each relevant jurisdiction.
8. Confidentiality and Security
Portcast keeps Confidential Information — including a Client's Data — confidential, and uses it solely to fulfil our obligations under our agreement with the Client, except as described in this Policy or as otherwise agreed. Confidential Information is not disclosed to third parties except as required by law, in connection with a bona fide sale of Portcast's business (subject to a confidentiality agreement with the acquiring party), or with prior written consent.
Portcast uses reasonable efforts to keep the Service secure and free of viruses or other harmful code, and to keep it available and uninterrupted, in accordance with generally accepted industry practice.
9. Access to Information
Access to Data is limited to Portcast personnel who require it to provide the Service and to meet our contractual obligations to the relevant Client.
10. Your Rights and Client Responsibilities
Because Portcast acts as a data intermediary on behalf of our Clients, individuals whose Personal Data is processed through the Service should direct requests relating to that data (such as access, correction, or deletion requests) to the relevant Client, who controls that data and is responsible for responding to such requests in accordance with applicable law. Portcast will support Clients in meeting these obligations as required under our agreement with them.
11. Governing Law
This Policy, and the processing of Data described in it, is governed by the laws of Singapore, including the Personal Data Protection Act 2012.
12. Changes to This Policy
We may update this Privacy Policy from time to time.
